Can Anyone Immigrate to Canada?

Other than the United States, which is limiting its immigration quotas, Canada is one of the countries in the Northern Hemisphere that admits the most immigrants. This is because it has a vast landmass but has a small aging population. This means that its population increase by natural birth cannot counter the aging population and the economic needs of the country. This calls for the country to look beyond its natural borders for labor and economic manpower. Because of Canada’s straight-forward immigration laws, it has become a magnet for many who are seeking a better way of life for themselves and their immediate families. But can anyone immigrate to Canada if they want to? The answer is yes and no. Let’s see.

Canadian Immigration Act of 2008 First of all, before you can immigrate to Canada, you must acquaint yourself with the Canadian Immigration Act of 2008. It is an amendment of the previous version of the site and the Canadian immigration minister insists it has made immigration to Canada easier.

Personal records

Immigration to Canada will require a criminal background check. This in and of itself does not disqualify you. It simply means that the Canadian authorities will request a copy of your criminal record. Certain classes of people may be deemed inadmissible but others can get a certificate of rehabilitation which means that five years have passed since you committed the crime and you have not committed another one since then.

Skills

It is generally considered harder to immigrate to Canada if you have no business skills. Canada is seeking people who will make it competitive in the world market and if you do not possess any skills or have not worked in a specific field for 2 years then you may not qualify. There is an amendment in the Canadian Immigration Act for people that have lived and worked in the United States for more than 2 years.

Family ties

If you have immediate family who are legally in Canada, you may qualify to immigrate as long as they file for you. They must be immediate family and they must be legally in Canada (holding a work authorization permit or a permanent residence card)

Refugees

If you are a resident of a country that is war torn you may apply to immigrate to Canada as a refugee. This may require proof that your life will be endangered if you are returned to your home country. Religious and political persecution also qualifies one to apply as a refugee.

Immigrate To Canada – Part 6 – Family Class Immigration

Family Class is the second class that is accepted by the authorities of Canada for immigration. A Family Class immigrant must be sponsored by close family members such as: parent, fiancé/fiancée or spouse who are Canadian citizens or permanent residents. Sponsors must promise to support the relative or family member and their accompanying member for a period of three to ten years to help them settle in Canada.

Sponsors living in Canada can sponsor:

- spouses, common-law or conjugal partners 16 years of age or older

- parents and grandparents

- dependent children, including adopted children

- children under 18 years of age whom you intend to adopt

- brothers, sisters, nephews, nieces or grandchildren who are orphans

- relative of any age if you do not have an aunt, uncle or family member from the list above who you could sponsor or who is already a Canadian citizen, Indian or permanent resident.

Dependent children

Your child or child of your spouse or common-law partner will be considered a dependent child if that child:

- is under the age of 22 and not married or in common-law relationship or

- married or entered into a common-law relationship before the age 22 and since becoming a spouse or a common-law partner, has:

* been continuously enrolled and in attendance as full-time student in a post secondary institution accredited by the relevant government authority and

Adopted children and orphaned relatives

A permanent resident visa can not be issued to a child as a member of the family class if that child is the adopted child of the sponsor or an orphaned brother, sister, nephew or niece of the sponsor as described above, unless the adoptive parents / sponsor demonstrates they have obtained information concerning the medical condition of the child. In doing so the government ensures that the child’s best interests are protected

Medical requirements

To be accepted you and your family members must not have a condition that is a danger to public health or safety or would cause excessive demand on health or social services in Canada

Before any applicant under the Family Class program submits his/her application, their sponsor must apply from inside Canada to be your sponsor

Sponsoring a Family Member to Immigrate to Canada

Family Class Sponsorship

A key principle in Canadian Immigration law is the goal of reuniting families in Canada.

Accordingly, a Canadian citizen, or a Permanent Resident of Canada, being at least 18 years of age, may sponsor certain close members of the sponsor, e.g. spouse, parents, grandparents, dependent children.

Certain distant relatives, e.g. sibling, nephew, niece, grandchildren, may only be sponsored under certain conditions, such as they need to be under 18 years of age, not married, or in a common law relationship, and no living parents.

A sponsor can also bring to Canada an adopted child, provided certain conditions are met e.g. is the adoption in the best interest of the child, has a home study been conducted.

Citizenship and Immigration Canada requires that the sponsor meet a certain level of income, with specific exceptions, e.g. if the sponsored person is the spouse or dependant child.

The sponsor must meet certain requirements, to be eligible, e.g. no criminal record, not in receipt of social assistance and has not declared bankruptcy.

Lastly, a non-relative of the sponsor, who is totally dependant on the principal applicant being sponsored, or emotionally, can also be sponsored on humanitarian and compassionate grounds.

Although it may take years to complete the immigration process, however, if a spouse is being sponsored, the application is expedited, and it may take only 1 year. This is the policy of Citizenship and Immigration Canada.

I hope this brief article has been of some assistance, in providing information on family sponsorship to Canada.

Immigrating to Canada As a Skilled Worker

Canada is still one of the most liberal and welcoming nations on earth when it comes to immigrating. In the last few years, millions and their families have immigrated to Canada and settled. The high standard of living in Canada coupled with the low crime rate continues to attract hordes of people from many different countries. One of the best ways to immigrate to Canada is as a skilled worker. Let us examine a few ways of doing this:

Federal skilled worker applications

Those that were received on or after February 27, 2008 are now being assessed for eligibility by the Minister of Citizenship, Immigration and Multiculturalism. Your application is deemed eligible if:

1. You possess a pre-arranged offer for employment from a registered company operating in Canada.

2. You are a foreigner already living in Canada legally for more than a year or

3. You are an international student in legal status or

4. You are a skilled worker with at least a year or more experience in the eligible professionals stated on the form.

5. You possess work experience which requires Skill Type 0 (managerial occupations) or Skill Level A (professional occupations) or B (technical occupations and skilled trades) as stipulated on the Canadian National Occupational Classification list, AND

6. You must have had this experience within the last 10 years.

The above are the factors that the Canadian immigration uses to assess eligibility to be admitted into Canada with a work Visa. Once your application is deemed eligible, it is then passed through an additional screening process which is gauges:

The Canadian immigration screening process

a. Your academic achievements

b. Your age

c. Your overall work experience

d. Your ability to speak and write English or French.

You must also show proof of financial responsibility in that you have enough money to support yourself and your dependants for the first few months of arrival. Most put this cap at $10,000.

Many people get discouraged by these requirements but if you examine them closely, you realize that they are more lenient than most of the immigration requirements of most countries, for instance, the US and the EU. The financial responsibility part also acts as a barrier for many people especially those who have little income. But you must understand that as a country, Canada must safeguard its welfare system. It is harder for immigrants who come in with no means of supporting themselves because they become a burden to the system and to other newly-arrived immigrants as well.
